BYE LAW ENFORCEMENT DIVISION

Bye Law Enforcement Division is a division under Legal Services Department; it is currently headed by Senior Bye Law Enforcement Technician who is supervising two Field Assistants. The division is at the meantime reporting to Town Clerk as a result that the position of the Principal State Counsel is vacant.

THE DIVISION MANDATE
The office of Bye Law Enforcement is created by Local Government Act, 2012 section 51 which put it thus ‘there shall be established a law enforcement office in every Council to enforce bye-laws which are made by the Council and any other laws delegated to be enforced by Council’.

The above section summarizes it all about the mandate of the division, its responsibility is to enforce all bye laws which are made by the Council and other laws delegated to the authority for enforcement. The following are some of the bye laws and other legislation which the bye law enforcement office enforces;

  • Dog bye laws
  • Noise and Nuisance bye laws
  • Street and Hawkers bye laws
  • General bye laws
  • Trade Act
  • Liquor Act
  • Industrial Act

The Division is also responsible for the reviews and formulations of both the existing and new bye laws of the Council in liaison with other stakeholders for efficient service delivery. Bye law enforcement division is a stakeholder to business inspection by means of checking compliance, the division also takes part in combating illicit behavior through law enforcement committee which involves external departments like Botswana Police Services , Immigration, Labour , BURS, Transport depart, Civil and National Department etc. The division is also a procuring entity for private security and mandated to supervise the aforementioned outsourced service which renders the service of securing the facilities of the Council.
